ตามปัญหารูปคดีเราต้องพิสูจน์ให้ได้ว่าขณะเกิดเหตุรถเราจอดอยู่และเปิดสัญญานไฟและถูกรถจยย.พุ่งเข้ามาชน การค้นหาพยานหลักฐานดูว่าบริเวณที่เกิดเหตุมีกล้องวงจรปิดหรือไม่ เพราะมันอาจถ่ายภาพในขณะเกิดเหตุไว้อาจจะเป็นประโยชน์ต่อคุณได้ในการพิสูจน์ข้างต้น หาพยานบุคคลในบริเวณที่เกิดเหตุในเวลาที่ใกล้เคียงการเกิดเหตุ การถ่ายภาพสถานที่เกิดเหตุ การเทียบรอยรถทั้งสองคันเพื่อหามุนเข้าชน หากพงส.มีความยุติธรรมก็คงฟ้องคนขับรถจยย.ฝ่ายเดียวในข้อหาขับรถในขณะเมาสุราเป้นเหตุทรัพย์สินผู้อื่นเสียหายแต่เท่าที่เห็นมาพงส.จะฟ้องทั้งสองฝ่าย ให้ไปสู้กันเองในศาล ปัญหาต่อมารูปคดดีอยู่ที่ความสามารถของทนายความว่าฝ่ายใดจะสามารถค้นหาหลักฐานเพื่อพิสูจน์ว่าตนไม่ได้กระทำผิดตามฟ้อง สำหรับความรับผิดทางแพ่ง หากคดีอาญาศาลเห็นว่าประมาททั้งสองฝ่ายความเสียหายทางแพ่งก็เป็นพับ แต่หากคุณประมาทฝ่ายเดียวโดยยกฟ้องคนขับรถจยย. คุณต้องรับผิดต่อค่ารักษาพยาบาลแม้ว่าเขาจะสามารถเบิกได้ก็ตาม คำแนะนำข้างต้นรีบดำเนินการหาทนายความช่วยเหลือหากทำเองไม่ได้
