พี่ชายโดนรถชนตายคาที่

พี่ชาย อายุ 26 ปี โดนรถชนเสียชีวิตคาที่ เมื่อวันที่ 20/02/53 พี่ชายขี่มอเตอร์ไซ คู่กรณีขับรถเก่ง อายุ 62 ปี เมาสุรา เป็นข้าราชการบำนาญ เหตุเกิดจากทั้งสองฝ่ายได้ขับรถสวนทางกันแต่รถเก่งได้แซงรถกระบะซึ่งอยู่ด้านหน้าเลยขับออกมากินเลนของผู้เสียชีวิตทำให้ประทะเข้าอย่างจังทำให้พี่ชายเสียชีวิตคาที่ โดยนอนตายอยู่ที่ประตูด้านคนขับ และเมื่อตำรวจมาก็รีบขึ้นไปนั่งบนรถตำรวจทันที แต่ตำรวจกลับบอกว่า ประมาทร่วม ข้อสังเกตุ 1. ตำรวจไม่ตรวจแอลกอฮอล
2. ตำรวจไม่ยอมพ้นสีบริเวณที่เกิดเหตุ
3. เมื่อฝ่ายผู่เสียชีวิตไปขอรูปถ่ายที่ตำรวจกลับบอกว่า แบตเตอร์รี่หมดถ่ายได้แค่รูปเดียว
4. ตำรวจให้มารดาของผู้เสียชีวิตยอมรับว่าประมาทร่วม
5. ผู้ขับรถเก่งบอกว่าเขาไม่ผิด และบอกตำรวจว่าประมาทร่วม
6. พี่ชายซื้อรถเมื่อวันที่ 20/02/52 เสียชีวิตวันที่ 20/02/53 เวลา 21.30 น. ได้ทำประกันอุบัติเหตุไว้กับบริษัทรถแต่ในใบประกัน พิมพ์ว่าสิ้นสุด 16.30 น. อยากทราบว่าจะได้เงินหรือเปล่า จริงๆแล้วควรจะคุมครองถึง 24.00 น. มั้ย
7. ตอนร้อยเวณนัดพบเพื่อพูดคุยกับฝ่ายตรองข้าม ตำรวจได้เรียกแม่เข้าไปคนเดียวแต่ดิฉันหน้าด้านเดินตามแม่ไป และเรียกอีกฝ่ายเข้าไปด้วยแต่เป็นทนายและประกันของรถเก่ง ดิฉันคิดว่ามันผิดสังเกตุเพราะแม่เป็นชาวบ้านไม่รู้รื่องเลยเกี่ยวกับกฎหมายเข้าไม่ยอมให้อาเข้าไป แต่อีกฝ่ายกลับให้ทนายเข้าไป
8. ตอนนี้ยังไม่ได้รับเงินสักบาทเดียว และไม่มาขอโทษรวมทั้งมาเยี่ยม มีแต่หาคนรู้จักมาขอเคลียเพื่อให้เรื่องจบ

ถึงคุณchantavat/กรณีตามปัญหาผมเห็นว่าตำรวจได้กระทำสิ่งที่ไม่ถูกต้องเห็นควรร้องขอความเป็นธรรมต่อผู้บังคับบัญชาขอเขาโดยตรงต่อไป และควรขอรูปถ่ายจากประกันภัย หรือเจ้าหน้าที่มลูนิธิที่มาถ่ายรูปไว้เพื่อหากจำเป็นต้องฟ้องเรียกค่าเสียหายทางแพ่งหรือร้องขอความเป็นธรรมในชั้นพนักงานอัยการต่อไป และหากจำเป็นก็ไปถ่ายรูปเองก็ได้ เชื่อว่าหลักฐานยังคงอยู่ คดีแบบนี้เคยเป็นตัวอย่างในคำพิพากษาของศาลฏีกาได้วินิจฉัยการรวบรวมหลักฐานของพงส.ว่าตำกว่ามาตรฐาน ที่ควรจะเป็น ผลาทงคดีศาลพิพากษาให้ฝ่ายผู้ตายเป็นฝ่ายชนะคดี สำหรับเรื่องความค้มครองตามกรมธรรมนั้นตามคำอธิบายของ อาจารย์จิตติ ติงศภัทิย์ อธิบายว่า...หากสัญญาประกันภัยให้นับเวลาตั้งแต่เวลาทำสัญญาก็ให้นับตั้งแต่เวลาทำสัญญาเป็นต้นไป หากสัญญาระบุไว้ก็เป็นไปตามสัญญา สรุปกรมธรรมไม่คุ้มครอง คำแนะนำควรรีบหาทนายความเข้าช่วยเหลือเจรจาดีกว่าหากการเจรจาไม่สามารถตกลงกันได้ก็ควรฟ้องทางแพ่งโดยไม่ต้องรอผลทางคดีอาญา
